The Court of Appeal in Abuja has overturned the decision of the National and State Houses of Assembly Election Tribunal in Asaba and declared Ngozi Okolie of the Labour Party (LP) as the winner of the Delta State Aniocha/Oshimili Federal Constituency election held on February 25, 2023.
This decision resulted in the removal of Ndudi Elumelu from the Peoples Democratic Party (PDP) who had initially been declared the winner.
The Appeal Court criticized the tribunal for nullifying Okolie’s election and also rejected Elumelu’s petition before the trial tribunal, leading to the annulment of the previous judgment.
The court concurred with the Labour Party’s lawyer, Mahmud Magaji, SAN, stating that Okolie had been duly nominated and sponsored by his party and had resigned his position as a Senior Special Assistant (SSA) to the Delta State Government in accordance with the constitution.
