The Senate approved Clayton’s nomination in a 51-47 vote, with all Democratic senators voting against his confirmation. Trump welcomed the decision, describing Clayton as “outstanding” and expressing confidence in his leadership.

Clayton, a former Securities and Exchange Commission chairman and federal prosecutor, succeeds Tulsi Gabbard, who resigned last month. He inherits an intelligence community that has experienced leadership changes and workforce reductions in recent months.

His confirmation comes as concerns grow over Trump’s renewed claims that the 2020 US presidential election was stolen. Earlier this month, Trump released declassified intelligence that he claimed showed Chinese interference in the election, despite no evidence supporting widespread election fraud.

During his confirmation hearing, Clayton drew criticism after declining to directly state that former President Joe Biden won the 2020 election, saying only that Biden had been “certified” as the winner.

Democratic lawmakers questioned whether Clayton would remain independent from political influence. Senate Intelligence Committee Vice Chair Mark Warner said he had “serious reservations” about Clayton’s willingness to resist political pressure, while Senate Democratic leader Chuck Schumer described his confirmation hearing as “abysmal.”

Republicans, however, defended Clayton’s qualifications, citing his previous leadership at the SEC and experience handling financial crime and national security cases.

His appointment is also expected to influence ongoing discussions over renewing Section 702 of the Foreign Intelligence Surveillance Act, a key surveillance authority that has become a subject of political debate.
