The annual ‘Warri Again Concert’ has taken an unexpected legal turn as Brownhill Investments Company Limited, the event’s organizers, have filed a lawsuit against Nigerian superstar David Adeleke, popularly known as Davido.
VerseNews reports that the lawsuit, marked EHC/183/2023, was lodged before the Delta State High Court in Effurun.
Owned by the former President of the Nigeria Football Federation (NFF), Amaju Pinnick, Brownhill Investments Company Limited is seeking N2.3 billion in damages from Davido, citing an alleged breach of the agreement/contract they entered into.
The claimant, represented by their lawyer, Kelechi Onwuegbuchulem, is requesting the court to award N2 billion as general damages against Davido and his music label, Davido Music Worldwide Limited.
Additionally, they are asking for N150 million as legal and professional fees and an extra N30 million as the cost of filing the suit.
Furthermore, the organizers are seeking a court order for Davido to issue a public apology on all of his social media accounts and in two national daily newspapers for four consecutive days, directed to the claimant and attendees.
The dispute stems from an agreement in early 2023 when Davido approached Amaju Pinnick, proposing his participation in the 19th edition of the ‘Warri Again Concert’ scheduled for October 6, 2023.
After negotiations, they settled on a performance fee of N70 million, and an equivalent of $94,500 was paid on April 6, 2023, which the defendants acknowledged.
Despite Davido recording a promotional video for the event, he ultimately failed to appear on the scheduled date.
The organizers claim to have invested significantly in print and social media advertising and promotions.
On September 29, 2023, a formal reminder letter was sent to Davido, including the flight itinerary of a private jet chartered for his transportation to and from Warri, incurring additional expenses of $18,000.
With Davido and his team failing to respond on the event day, Brownhill Investments Company Limited is demanding the payment of the full $94,500 for engaging Davido’s services.
